1. Virginia Fair Housing Law, Code of Virginia § 36-96.3. Unlawful discriminatory housing practices. This statute makes it illegal "To represent to any person because of race, color, religion, national origin, sex, elderliness, familial status, or handicap that any dwelling is not available for inspection, sale or rental when such dwelling is in fact so available." Providing demographic information to influence a housing decision falls under this prohibition.
2. Code of Virginia § 54.1-2138. Disclosure of brokerage relationship. Section A states, "A licensee shall disclose in writing to any prospective purchaser or tenant who is not the client of the licensee and who is not represented by another licensee...the party for whom the licensee acts as agent."
3. Virginia Real Estate Board Regulations, 18 VAC 135-20-260. Duty to disclose material facts. This regulation requires licensees to "disclose to their client all material facts related to the property or concerning the transaction of which they have actual knowledge." This includes a party's financial standing if it impacts the transaction.
4. Code of Virginia § 54.1-2131. Standard agent; duties. Section A.2. requires a licensee representing a seller to "Promote the interests of the seller by...Presenting all offers and counteroffers to and from the seller in a timely manner, even after the property is subject to a contract of sale."
